Terms of Service

The short version: you keep the rights to your photos, you get to use the images Sceneshift makes for you commercially, the AI is imperfect so check the results, and the service is early and may change. The rest of this page says that carefully.

The agreement

These terms are between you and Gokul Gopalakrishnan, an individual sole trader operating Sceneshift at getsceneshift.com. By creating an account or using the service you agree to them. If you do not agree, do not use Sceneshift.

Our Privacy Policy is part of these terms.

Who can use it

You must be at least 18 and legally able to enter a contract. If you are using Sceneshift for a business, you confirm you are authorised to accept these terms on its behalf.

Your account

You are responsible for keeping your password safe and for everything that happens under your account. Tell us promptly if you think someone else has access to it.

Give us an email address that reaches you. It is how we send sign-in confirmations and how we would tell you about a problem.

Early access and access codes

Sceneshift is currently in early access. Entry is by access code, each of which is valid for a limited number of accounts. Codes may be withdrawn or deactivated at any time, and a code that has reached its limit will stop working.

Early access means the product is incomplete and actively changing. Features may be added, altered, or removed. We will not break your existing generated images without telling you.

Credits

One credit produces one generated image. Credits are granted when you redeem an access code and are deducted when a generation starts.

  • If a generation fails, the credit is returned to you automatically. If you are ever charged for a failed generation, tell us and we will put it back.
  • Credits have no cash value and cannot be exchanged for money.
  • Credits granted during early access do not expire while your account is open.
  • We may rate-limit generations to keep costs under control. The current limit is 20 generations per hour per account.

Paid plans are not yet available. When they are introduced, their pricing, billing cycle, and refund terms will be published before you are asked to pay for anything, and no existing free credit will be taken away.

Your photos stay yours

You keep every right you already had in the photos you upload. We claim no ownership of them.

You give us permission to store your photo and to send it to our image-generation provider, for the sole purpose of producing images for you. That permission is limited to running the service. We do not use your photos to train models, we do not license them to anyone, and we do not publish them.

The images Sceneshift makes for you

As between you and us, the generated images are yours. We assign you whatever rights we hold in them, and you may use them for any lawful purpose, including commercially — on your product listings, your website, your packaging, your ads, and your social media. You do not need to credit Sceneshift.

Two honest limits you should understand before relying on them:

  • We cannot give you rights we do not have. In the United States and several other countries, material generated by an AI system without meaningful human authorship may not attract copyright protection at all. That means you may not be able to stop someone else from copying an image Sceneshift made for you. This is a limitation of the law, not of our intentions.
  • The images are not exclusive to you. Another customer who uploads a similar product and picks the same scene may receive a visually similar result. We do not guarantee that any image is unique.

You are responsible for making sure your use of a generated image is lawful — including that it does not mislead buyers about what they are purchasing.

What you must not upload

You confirm that you own the photos you upload, or otherwise have permission to use them. Do not upload:

  • Anything you do not have the rights to.
  • Photos of identifiable people who have not agreed to it.
  • Anything unlawful, sexual, hateful, or depicting violence.
  • Anything that infringes someone else's trademark or copyright.

You also agree not to resell or white-label the service, attempt to circumvent credit limits or rate limits, probe or attack the infrastructure, or use automated tools to generate images at scale outside the normal interface.

We may remove content and suspend accounts that break this section.

The results are imperfect

Sceneshift uses a generative model. It produces convincing product photography most of the time and sometimes produces something wrong. In particular, small printed text on packaging and labels frequently comes out garbled or invented.

Check every image before you publish it. We provide the service as-is and do not warrant that any particular image will be accurate, usable, or fit for your purpose. You are the one deciding whether a result is good enough to represent your product.

Availability

We try to keep Sceneshift running but do not promise any level of uptime. It depends on third-party services that can fail, and it may be unavailable for maintenance, or because a provider is down.

We may change or discontinue the service. If we discontinue it entirely, we will give you reasonable notice and a chance to download your images.

Ending it

You may stop using Sceneshift at any time and ask us to delete your account by emailing support@getsceneshift.com.

We may suspend or close your account if you break these terms, if we are required to by law, or if keeping it open exposes us to real cost or risk. Except where you have seriously breached these terms, we will tell you why.

Download anything you want to keep before closing your account.

Liability

Sceneshift is provided as-is and as-available, without warranties of any kind beyond those that cannot lawfully be excluded.

To the fullest extent the law allows, we are not liable for lost profits, lost sales, lost data, or any indirect or consequential loss arising from your use of the service. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or fifty US dollars.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. If you are a consumer, you keep any statutory rights your local law gives you.

Your responsibility to us

If someone brings a claim against us because of content you uploaded or how you used a generated image — for example, a copyright claim over a photo you did not have the rights to — you agree to cover our reasonable costs in dealing with it.

Changes to these terms

We may update these terms. The date at the top of the page shows when they last changed. If a change materially reduces your rights, we will email you before it takes effect. Continuing to use Sceneshift after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Disputes will be heard by the state or federal courts located in California, and you and we both agree to that jurisdiction.

If any part of these terms is found unenforceable, the rest stays in force.
